Land Development Division applications and submittal guidelines and requirements are listed below by Public Hearing Applications and by administrative Development Review Applications.
All application submittals are through the City’s iMS Online Portal.
Public Hearing Applications
The applications below requires public hearings before the Planning and Zoning Board and/or the City Council. Accurate and complete submittals of all requested items will facilitate a more efficient and timely application process. Only applications that are deemed sufficient and complete will be processed. Any mislabeled files may also delay the review process.

Application to amend the Land Development Code and other applicable codes of the Palm Bay Code of Ordinances.

Application for a Comprehensive Plan Future Land Use Map amendment or for a Textual amendment to the Palm Bay Comprehensive Plan.
The Interactive Zoning and Future Land Use Map can be used to identify zoning and land use designations assigned to Palm Bay properties.
Future Land Use Map Amendment
Application for a Comprehensive Plan Future Land Use Map amendment.
Small-Scale amendment – 50 acres or less.
Large-Scale amendment – More than 50 acres.
Please note, the following documents and information may be required before application can be submitted. Additional documents may be required upon request by city staff:
- Pre-Application Meeting - The Pre-application meeting provides an opportunity to discuss the review process and address concerns, if any, with City staff prior to formal submittal.
- 500-Foot Radius Mailing - Full radius package of property covered by the application with the names, mailing addresses, legal descriptions, and correlating map of all respective property owners within the referenced area. This should be obtained from the Brevard County Information Technology Department at GISrequest@brevardfl.gov by emailing the Tax Account Number(s) of referenced area; specify the request is for the 500-Ft. Radius Package; and provide your name and telephone number.
- Owner's Authorization Letter - Where the property owner(s) are not the representative for the request(s), notarized consent from all property owners must be provided to authorize the representative(s).
- Citizen Participation Plan & Report - CPP meetings are to occur prior to the application submittal. Refer to Section 172.012 of the Land Development Code for guidelines and CPP Report Form.
- School Board Impact Analysis Application (if applicable) - The application is obtained from the Planning and Project Management Department of the School Board of Brevard County at (321) 633-1000, extension 11418.
- Site Sketch - A legal description of the subject properties with a sketch to scale of the legal descriptions.
- Planning and Zoning Board Factors and Analysis – This form must be completed in its entirety.
- Natural Resources Assessment – A brief environmental summary of the subject property that shall include information regarding any natural habitats (FLUCCS Map) and species on the site and within the immediate vicinity; the site’s proximity to surface waters (natural and manmade); and if the site is within the protected Turkey Creek or Indian River Lagoon watersheds.

- Meeting Sign - Staff will provide a sign template for applicants to erect meeting signage on the subject property. Refer to Section 51.07(C) of the Code of Ordinances.
Textual Amendment
Application for a Textual Amendment to the Palm Bay Comprehensive Plan which is comprised of the following ten elements:
- 01 Future Land Use Element (FLU)
- 02 Transportation Element (TE)
- 03 Housing Element (HSG)
- 04 Coastal Management Element (CME)
- 05 Recreation and Open Space Element (ROS)
- 06 Conservation Element (CON)
- 07 Infrastructure Element (INF)
- 08 Intergovernmental Coordination Element (ICE)
- 09 Capital Improvement Element (CIE)
- 10 Private Property Rights Element (PPR)

Following Sufficiency Review of Submittal:

Application for a Conditional Use for special consideration regarding the suitability and compatibility of a specific use at a location and development in particular zoning districts. Conditional Use application requirements are evaluated based on Section 172.024 of the Code of Ordinances.
The designated conditional uses within the appropriate zoning district classifications are set forth in Chapter 173.

- Pre-Application Meeting - The Pre-application meeting provides an opportunity to discuss the review process and address concerns, if any, with City staff prior to formal submittal.
- 500-Foot Radius Mailing - Full radius package of property covered by the application with the names, mailing addresses, legal descriptions, and correlating map of all respective property owners within the referenced area. This should be obtained from the Brevard County Information Technology Department at GISrequest@brevardfl.gov by emailing the Tax Account Number(s) of referenced area; specify the request is for the 500-Ft. Radius Package; and provide your name and telephone number.
- Owner's Authorization Letter - Where the property owner(s) are not the representative for the request(s), notarized consent from all property owners must be provided to authorize the representative(s).
- Citizen Participation Plan & Report - CPP meetings are to occur prior to the application submittal. Refer to Section 172.012 of the Land Development Code for guidelines and CPP Report Form.
- Site Sketch - A legal description of the subject properties with a sketch to scale of the legal descriptions and proposal.

- Meeting Sign - Staff will provide a sign template for applicants to erect meeting signage on the subject property. Refer to Section 51.07(C) of the Code of Ordinances.
Application to establish or amend a Development Agreement. Provisions of Development Agreements addresses developments within the City that impacts public facilities, such as roads, stormwater, utilities, parks, and public safety infrastructure, for which a developer shall be required to improve as a result.
Please note, the following documents and requirements must be accomplished in compliance with Sections 172.090 through 172.093 of the Palm Bay Code of Ordinances and with Chapters 163.3220 through 163.3243, Florida Statutes. Additional documents may be required upon request by city staff:
- Owner's Authorization Letter - Where the property owner(s) are not the representative for the request(s), notarized consent from all property owners must be provided to authorize the representative(s).
- Draft Development Agreement
- Site Plan
- Declaration of Covenants (HOA, POA, or CDD)
- Draft Utility Agreement
- Narrative and Explanation of Request - The proposed location of the land, development uses, population densities, and building intensities and height shall be included.

Development Agreement Amendment:
Applicants of existing Development Agreements must notify the Land Development Division to enable submittal of an Amendment application. Amendments must comply with Section 172.093(H) of the Palm Bay Code of Ordinances.
Following Sufficiency Review of Submittal:
- Non-Refundable Application Fee: $2,500.00 Amendment
Application to grant a street name change by the City Council in cooperation with Brevard County E-911 Street Naming Office. Street naming guidelines are located in Section 176.006 of the Code of Ordinances.
Please note, the following documents and information may be required before application can be submitted. Additional documents may be required upon request by city staff:
- Mailing Package - Full mailing package of all properties that abut the roadway under consideration with the names, mailing addresses, legal descriptions, and correlating map of the respective property owners. This should be obtained from the Brevard County Information Technology Department at GISrequest@brevardfl.gov by emailing the Tax Account Number(s) of referenced area; specify the request is for the properties that abut the roadway under consideration; and provide your name and telephone number.
- Response Letters - The applicant shall use the Template Response Letter to obtain responses from the abutting property owners.
There is no application fee to rename a roadway.
Applications to rezone a property to an established zoning district based on consistency and compatibility with the current Zoning Map and Comprehensive Plan.
Comprehensive Plan Zoning Amendment - Application selection to rezone a property in conjunction with a Comprehensive Plan Future Land Use Amendment application.
Zoning Change - Application selection when a Land Use Amendment is NOT being submitted.
These rezoning applications pertain specifically to the Zoning District Regulations located in Section 173 of the Code of Ordinances:

Applications for subdivision plats and planned developments include the following for public hearing review:
- Planned Development (PUD / PMU / PCRD / RAC)
- Preliminary Subdivision Plan (Plat)
- Petition to Vacate Plat
- Final Plat
Planned Development (PUD / PMU / PCRD / RAC)
Application for Preliminary Development Plan approval and/or Final Development Plan approval to permit more flexibility for the total use of a site.
Preliminary Development Plan – Procedures and requirements can be found in Section 172.030 of the Code of Ordinances.
Final Development Plan – Procedures and requirements can be found in Section 172.031 of the Code of Ordinances.
As these applications apply to four specific zoning categories, additional conditions must be met and incorporated into the site plan for the specific type of development request per Sections 173.062 through 173.086:
PUD - Planned Unit Development District
PCRD - Planned Community Redevelopment District
PMU - Parkway Mixed Use District
RAC - Regional Activity Center District

- Pre-Application Meeting - The Pre-application meeting provides an opportunity to discuss the review process and address concerns, if any, with City staff prior to formal submittal.
- 500-Foot Radius Mailing - Full radius package of property covered by the application with the names, mailing addresses, legal descriptions, and correlating map of all respective property owners within the referenced area. - Owner's Authorization Letter - Where the property owner(s) are not the representative for the request(s), notarized consent from all property owners must be provided to authorize the representative(s).
- Preliminary Development Plan - Plan submittal for preliminary development review.
- Final Development Plan - Plan submittal for final development review.
- Schematic Drawing - A drawing of the elevation and architectural construction of the proposed primary and secondary nonresidential structures.
- Vicinity Map - A map clearly outlining the subject property and showing the relationship between the site and its surrounding area including adjacent streets and thoroughfares.
- Boundary Survey - The survey shall also include the location, size and type of all trees per the tree standards identified in Chapter 175 of the Code of Ordinances.
- Site Sketch - A legal description of the subject properties with a sketch to scale of the legal descriptions.
- Traffic Study - A hard copy must also be provided to the Land Development Office.
- Vehicular and Pedestrian Circulation Plan - A plan of vehicular and pedestrian circulation showing the general locations and right-of-way widths of roads, sidewalks, the capacity of the system and major access points to the external and internal thoroughfare network.
- Dedication Instruments - If applicable, instruments dedicating all public right-of-way, easements, lands.
- Narrative Summary - Narrative describing in detail how the proposed development meets the requirements of the Land Development Code and the Palm Bay Comprehensive Plan.
- Development Schedule - The schedule shall contain the order of construction stages, proposed beginning and completion dates of stages, and schedule of the construction and improvement of common open space and complementary buildings within the stages.

- Citizen Participation Plan & Report - CPP meetings are to occur prior to the application submittal. Refer to Section 172.012 of the Land Development Code for guidelines and CPP Report Form.

- Meeting Sign - Staff will provide a sign template for applicants to erect meeting signage on the subject property. Refer to Section 51.07(C) of the Code of Ordinances.
Preliminary Subdivision Plan (Plat)
Application for the Preliminary Subdivision Plan review of a preliminary plat. Approval of a Preliminary Subdivision Plan shall not constitute approval of the final plat but is deemed an expression of approval of the layout submitted on the plan as a guide to the preparation of a final plat subject to City Council approval. Residential development types can be found in Sections 173.030 through 173.034 of the Code of Ordinances. Application for Preliminary Subdivision Plan requires Planning and Zoning Board and City Council review.

- Pre-Application Meeting - The Pre-application meeting provides an opportunity to discuss the review process and address concerns, if any, with City staff prior to formal submittal.

- Preliminary Subdivision Plat - The plan must meet the requirements of Chapter 172.052 of the Code of Ordinances. Refer to Chapter 172.050 through 172.061 of the Code of Ordinances to review the full Subdivision Ordinance.

If the plan involves a replat of the same lands, final plat approval will be conditioned upon applicant fully complying with Florida Statutes Chapter 177, regarding vacation and annulment of prior lands. Notice is given at this time so you may begin the required procedure for vacating plat. All documents required by F.S. 177 must be submitted to the city clerk prior to final plat approval.
Should the developer or owner or their successors, heirs, or assigns execute a document entitled "easement agreement" with the Melbourne Tillman Water Control District, the City of Palm Bay will not at any time accept such structure for maintenance purposes. Further, the City of Palm Bay will take no formal action to accept any dedication of such structures.

Petition to Vacate Plat
Application for vacating a plat as required prior to the approval of a replat or final plat of the same property. The vacating cannot affect the ownership or right of convenient access of persons owning other parts of the subdivision and must adhere to Chapters 172.070 through 172.072 of the Code of Ordinances. Petition to Vacate a Plat requires City Council review.

- Pre-Application Meeting - The Pre-application meeting provides an opportunity to discuss the review process and address concerns, if any, with City staff prior to formal submittal.
- Owner's Authorization Letter - Where the property owner(s) are not the representative for the request(s), notarized consent from all property owners must be provided to authorize the representative(s).
- Fee Simple Title - Proof that applicant owns fee simple title to the whole or that part of the property covered by the plat sought to be vacated.
- Plat Map - Map of plat or portion thereof requested for vacating per Florida Statutes, Chapter 177.
- Tax Certificates - Copies of certificates verifying that all state, city, county, and municipal taxes have been paid.
Following Sufficiency Review of Submittal:
- Non-Refundable Application Fee: $250.00
Final Plat
Application for Final Plat review and approval. Residential development types can be found in Sections 173.030 through 173.034 of the Code of Ordinances. Application for Final Plat requires City Council review.

- 500-Foot Radius Mailing - Full radius package of property covered by the application with the names, mailing addresses, legal descriptions, and correlating map of all respective property owners within the referenced area. This should be obtained from the Brevard County Information Technology Department at GISrequest@brevardfl.gov by emailing the Tax Account Number(s) of referenced area; specify the request is for the 500-Ft. Radius Package; and provide your name and telephone number.
- Owner's Authorization Letter - Where the property owner(s) are not the representative for the request(s), notarized consent from all property owners must be provided to authorize the representative(s).
- Final Plat - The final plat must conform substantially to the approved preliminary plat and must meet the requirements of Chapter 172.053 of the Code of Ordinances. Refer to Chapter 172.050 through 172.061 of the Code of Ordinances to review the full Subdivision Ordinance.
- Construction Plans - The construction plans must include a construction schedule.

Public Hearing Variance
Application for a variance of 20 percent or greater to grant relief from the Land Development Code. Variance requests must meet the conditions of Section 172.025 of the Code of Ordinances.

- Pre-Application Meeting - A Pre-application meeting may be required to provide an opportunity to discuss the review process and address concerns, if any, with City staff prior to formal submittal.
- 500-Foot Radius Mailing - Full radius package of property covered by the application with the names, mailing addresses, legal descriptions, and correlating map of all respective property owners within the referenced area. This should be obtained from the Brevard County Information Technology Department at GISrequest@brevardfl.gov by emailing the Tax Account Number(s) of referenced area; specify the request is for the 500-Ft. Radius Package; and provide your name and telephone number.
- Owner's Authorization Letter - Where the property owner(s) are not the representative for the request(s), notarized consent from all property owners must be provided to authorize the representative(s).
- Site Plan - A site plan drawn to scale which shows all property and yard dimensions, its structures (if any) and the variance desired, including abutting highway or road boundaries. Site plan data may be shown on a copy of the survey.
- Survey - A survey prepared by a registered surveyor showing all property lines and structures.
- Bert J. Harris Private Property Rights Exemption - To claim exemption per Chapter 95-181, Laws of Florida, provide a copy of the special master appointed in accordance with the act or a court order as described in the act.
- Americans with Disabilities Exemption - To claim this exemption, the section of the act from which the variance request will provide relief must be cited.

- Meeting Sign - Staff will provide a sign template for applicants to erect meeting signage on the subject property. Refer to Section 51.07(C) of the Code of Ordinances.
Application to petition for voluntary annexation into the corporate city limits of Palm Bay in accordance with Chapter 172.020 of the Palm Bay Code of Ordinances and Section 171.044, Florida Statutes. If accepted by the Palm Bay City Council, the voluntary annexation shall be binding upon the petitioner and their successors, assigns and legal representatives, and shall be binding upon and run with the land.

- Owner's Authorization Letter - Where the property owner(s) are not the representative for the request(s), notarized consent from all property owners must be provided to authorize the representative(s).
- Deed(s) - Copy of the deed for each parcel requesting annexation.
- Survey(s) - Signed and sealed surveys for each parcel seeking annexation prepared by a registered surveyor showing all property lines and structures.
- Metes and Bounds - Metes and bounds legal description for each parcel seeking annexation.
- Map of Future Land Use

- Comprehensive Plan Future Land Use Map Amendment Application - A City of Palm Bay future land use designation must be assigned to all annexed properties.
Application for City Council to hear and decide appeals where it is alleged there is error in any order, requirement, decision, or determination made by the Growth Management Director in the enforcement of the city's land development regulations.

Alternative architectural styles can be considered administratively to provide relief from the style provisions. A Final Administrative Decision will be made by the Growth Management Director.

What is the purpose of a Pre-Application Meeting?
The Pre-application meeting provides the applicant an opportunity to discuss the review process and address concerns, if any, with City staff prior to formal submittal.
To familiarize City staff with a potential application, and to familiarize the potential applicant with the requirements of applicable City Codes, the Comprehensive Plan, and other relevant criteria and procedures.
- A pre-application meeting is not intended to be an exhaustive review of all potential issues.
- A pre-application meeting does not bind or preclude the City from enforcing all applicable regulations or from applying regulations in a manner differently than may have been indicated in the pre-application meeting.
- A pre-application meeting is Intended to be informational only and is not an approval in any manner.

- Narrative Describing the Project
- Current Property Boundary Survey (Signed and Sealed), to scale, with a north arrow, certified within 90 days, and identifying the following:
- All existing structures, and their setbacks from all property lines, including square footage and use of each.
- Designate the yards (i.e. front, rear, sides and side street) and annotate the yard designation on each lot of the approved survey and show the allowable building envelope;
- All existing or proposed easements;
- Identify wetland areas, include wetland line and acreage;
- Identify the Normal High Water Elevation (NHWE) for any water bodies, and depict the location of the NHWE contour line;
- Proposed Lot Reconfiguration and Legal Descriptions
- Identify each lot’s area - Total land area for each proposed lot, and net developable area for each proposed lot.
- Net Developable Land area (aka Upland Area) is the total lot area minus any wetlands, or any natural surface waters such as lakes or ponds (land that is beyond the (NHWE) contour is not considered upland). This is also referred to as “high and dry” area.
- Only non-submerged land that is landward of the NHWE is considered as upland area and counted for purposes of meeting density and zoning requirements.
- Legal descriptions of the parent tract and for each proposed lot;
- Identify the 100-year flood elevation;
- Label all adjoining rights-of-way;
- Show the proposed lot lines and lot dimensions;
- If septic systems or wells are proposed, the survey must indicate where any existing septic tanks, drain fields, and wells are located; and
- Authorization letters from the area’s controlling utility provider verifying the availability (or non-availability) of central sewer and/or water services.

- Notarized Agent Authorization form if applicant is not the owner of the property. Also, if there are multiple owners then a form is required for each individual or entity
- Existing Infrastructure details
- Identification of any existing septic systems and wells within 75 feet of the parent tract’s property lines (unless this separation can be accommodated entirely on the applicant’s property).
- Minimum Lot Standards and Regulations - All residential lots shall comply with all minimum lot size requirements, and all other applicable codes.
- All existing structures to remain must meet the required setbacks from any new lot line created through lot split, lot reconfiguration, or plat reversion
- For residential properties, any new lot created must be completely vacant, or contain a principal structure (dwelling unit). New lots created cannot solely contain accessory structures (such as sheds or pools). If any structures are shown on the survey submitted that do not meet setbacks, or are not permitted to remain, the application will be denied until such time as demolition permits have been completed, and updated surveys submitted
