Habitat Conservation Measures Effective from March 1 to June 30

In 2007, following the approval of the City’s Habitat Conservation Plan, the U.S. Fish and Wildlife Service issued an Incidental Take Permit (ITP) to the City of Palm Bay in accordance with Section 10 of the Endangered Species Act (ESA). The ITP authorizes permitted entities to undertake otherwise lawful projects that may result in the take of a threatened or endangered species.

According to the ESA, one of the accepted definitions for ‘take’ related to the harm of one of the species included in the City’s ITP, which includes significant habitat modification that impairs the nesting and reproduction of the animal. Palm Bay’s ITP covers three species: the Florida Scrub Jay, the Eastern Indigo Snake, and the Gopher Tortoise.

The City of Palm Bay is home to over 42,500 acres of anticipated Scrub Jay permit area and three specific, recognized Scrub Jay habitat areas. These federally-designated areas are also referred to as Scrub Jay occupied habitat polygons. The established nesting season for the Florida Scrub Jay begins on March 1st and ends on June 30th. Lot owners in the Scrub Jay occupied habitat polygons may build on their property during nesting season, however, land clearing is prohibited in these designated areas. While land clearing is not allowed during nesting season, landowners may attain a permit to clear land from July 1st through the end of February if the property meets certain requirements.

Building Safety Month

Throughout the month of May, our Building Department will participate in the 45th annual Building Safety Month, a worldwide campaign presented by the International Code Council, its members, and partners to promote building safety.

This year’s campaign, “Game On!” encourages people to get involved in all aspects of building safety. The campaign also makes the connection between building codes and personal safety, as well as the important work done by building safety professionals in our communities.

Our code officials work day in and day out to keep the public safe. We come together to support Building Safety Month because we understand the need for safe and sustainable structures where we live, work and play.  ePermitHub Digital Plan Room

Effective March 3rd, 2025, the City of Palm Bay Building Department implemented the ePermitHub Digital Plan Room. The Digital Plan Room will allow for complete electronic submission, review, and approval of all available permit applications. Applicants will be able to upload their plans and documents, view the status of their permits and reviews, address any outstanding issues, and download their approved plans and permit documents from their home, office, or mobile device.

Update to Florida Building Code:

Attention Builders and Contractors: Effective December 31, 2023, the Florida Building Commission published the 2023 Florida Building Code, 8th Edition. All permit applications submitted on or after December 31, 2023 to the City’s Building Department must comply with the new provisions. For more information, visit www.pbfl.org/FBC


Update to Building Department Fee Schedule:

Resolution 2025-11 amended Resolution 2024-30 of the City of Palm Bay adopting rates, charges and fees for FY 2024-2025, Chapter 96, Florida Building Code.  Resolution 2025-11 was approved by Council on March 6, 2025.  You can view the document at the following link: Resolution 2025-11


Permits Requiring Temporary Access to Melbourne-Tillman Canal ROW:  

Effective immediately, the City of Palm Bay Building Department will not issue permits that entail any temporary access of the property along the Melbourne-Tillman Canal, unless a permit has first been obtained by Melbourne-Tillman Water Control (MTWC) District. 

If property is adjacent to a Melbourne-Tillman water canal, a permit is required for temporary access of MTWC District's rights-of-way. For more information visit the Melbourne Tillman website. Please call (321) 723-7233  with any questions or concerns regarding MTWC permitting.
